OFFICIAL PROMOTION / SWEEPSTAKES RULES

  1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A purchase will not increase your chances of winning. The Promotion / Sweepstakes (hereafter referred to as Promotion) is subject to all Federal, State, Local and Municipal laws and regulations. Void where prohibited by law.
  2. SPONSOR: The Promotion is sponsored by Transitions Optical, Inc., 9251 Belcher Rd., Pinellas Park, FL 33782
  3. ELIGIBILITY: The Promotion is open only to legal residents of the United States, excluding Puerto Rico and protectorates, who are eighteen (18) years of age or older at time of entry. Promotion is not open to employees and directors of the Sponsor or any of their respective parent companies, affiliates, subsidiaries, advertising or promotional agencies, Sweepstakes judges and legal advisors, or to the immediate family members of, or to any persons domiciled with, any such person. All winners are subject to Sponsor’s verification of eligibility hereunder.
  4. PROMOTIONAL PERIOD: The Promotion will begin at 12:01 a.m. (EST) on June 1, 2008 and ends at 11:59:59 p.m. (EST) on November 30, 2008. Entries received outside of the entry period will be disqualified.
  5. PROMOTION COMPONENTS:
    1. Instant win component: A total of $230,000.00 has been allocated for this portion of the promotion. All instant win funds will be awarded. Individuals participating in the instant win component of this promotion will also automatically be entered into the grand prize sweepstakes component outlined in paragraph B below. Individuals participating in the instant win component of this promotion will have the opportunity to win up to $10,000.00 instantly via an online probability based game of chance. Entrants desiring to participate in this portion of the promotion will be required to obtain an eight digit promotional code which will be utilized during the on-line instant win promotional process. Purchasers of Transitions lenses will receive an eight digit promotional code preprinted on a certificate of authenticity accompanying their lenses. Individuals desiring to participate whom have not made a purchase can obtain an eight digit promotional code by sending a self addressed stamped envelope to: Transitions Promotional Code, P.O. Box 37, Fombell, PA 16123. Include a hand printed 3” x 5” piece of paper with your name, address, city, state, zip code, daytime phone (where you can be reached during normal business hours), birth date and the words “Transitions Get Healthy Sight Give Healthy Sight Code”. Only one request per self addressed stamped envelope permitted. Residents of Vermont may omit postage.

      In the event, upon conclusion of the promotion, all allocated instant win funds are not distributed, all remaining funds will be distributed through a second chance drawing from all instant win participants.

      IMPORTANT: ONLY ONE INSTANT WIN PRIZE PERMITTED PER PERSON AND/OR HOUSEHOLD. SPONSOR RESERVES THE RIGHT TO CONCLUDE THE INSTANT WIN COMPONENT OF THIS PROMOTION UPON DISTRIBUTION OF ALL ALLOCATED FUNDS.
    2. Sweepstakes component: There are two methods to enter:
      1. Enter Online: To enter online, access the Internet website at http://www.transitions.com and participate in the instant win component of the promotion, as outlined in paragraph A, above. You will automatically be entered into the grand prize sweepstakes. No more than one (1) online entry per day may be registered from the same computer terminal or from the same individual. Entrants may not enter with multiple e-mail and/or multiple identities, nor may entrants use any other device or artifice to enter more than once per day. Any entrant who attempts to submit more than one entry per day using multiple e-mail and/or multiple identities or uses any device or artifice may be disqualified. Once submitted, entry cannot be modified, returned or deleted. In the event of a dispute in connection with the identity of the individual who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If an eligible individual cannot be determined and verified in the manner described above, the entry will be disqualified as null and void and an alternate winner will be selected. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons determined, in Sponsor's sole discretion, to have used any such methods will be disqualified. ANY ENTRY WHICH DOES NOT CONFORM STRICTLY TO THESE REQUIREMENTS IS NULL AND VOID.
      2. Enter by mail: To enter by mail, complete the official entry form received with your Transitions Lenses Certificate of Authenticity, or hand-print on a 3”x 5” piece of paper your name, address, city, state, zip code, daytime phone number (where you can be reached during normal business hours), birth date and the words Transitions Get Healthy Sight Give Healthy Sight Sweepstakes. All mail-in entries must be mailed to: Transitions Get Healthy Sight Give Healthy Sight Sweepstakes, P.O. Box 37, Fombell, PA 16123. No photocopies, mechanical reproductions, altered, illegible, incomplete, mutilated, postage-due or forged entries will be accepted. Sponsor is not responsible for lost, mutilated or misdirected mail. All mail-in entries must be postmarked by November 30, 2008 and received by December 9, 2008. ALL OTHER MAIL-IN ENTRIES ARE NULL AND VOID.
      All entries become the property of Sponsor and none will be returned.
  6. SWEEPSTAKES PRIZES & ODDS OF WINNING: Grand Prize: Two (2) to be awarded. Prize: $10,000.00. Prizes will be awarded in the form of a check payable to the winner. Prizes are non-assignable and nontransferable. The winner is solely responsible for payment of any and all federal, state or local taxes pertaining to their prize. Odds of winning dependant upon the number of eligible entries received. ALL SWEEPSTAKES PRIZES WILL BE AWARDED.
  7. INSTANT WIN PRIZES & ODDS OF WINNING: All instant win prizes will be awarded in the form of a check payable to winner. Only one instant win prize permitted per household or participant. Odds of winning an instant win prize are 1:1. However, instant prize winners may elect to reject their prize and participate in a game of chance in an effort to win a higher valued prize. If during this game of chance process, the participant reveals a bankrupt symbol, any winnings earned prior to revealing the bankrupt symbol, will be forfeited. The participant may elect to claim their prize at any time prior to revealing a bankrupt symbol. Instant winners will receive an email notification confirming their instant winner status. Please allow six to eight weeks for delivery of instant win prizes. Instant prize winners are solely responsible for payment of any and all federal, state or local taxes pertaining to their prize. ALL ALLOCATED INSTANT WIN PRIZE FUNDS WILL BE DISTRIBUTED. In the event, upon conclusion of the promotion, all allocated instant win funds are not distributed, all remaining funds will be distributed through a second chance drawing from all eligible Grand Prize Sweepstakes entries received.

    IMPORTANT: A PARTICIPANT MAY ELECT TO REJECT THE INSTANT WIN PRIZE THEY HAVE WON IN AN EFFORT TO WIN A HIGHER VALUE PRIZE. IF AT ANY POINT DURING THIS PROCESS, A BANKRUPT SYMBOL IS REVEALED, THE PARTICIPANT IS NOT DUE ANY MONETARY PRIZE WHATSOEVER.
  8. DRAWINGS:
    Grand Prize Drawings: Grand Prize winners will be selected in random drawings conducted by an independent judging organization as outlined below:
    On or about the following dates: 8/31/2008 and 12/15/2008, a drawing will be conducted from all eligible entries received to date. Each drawing date will determine one (1) Grand Prize Winner.

    Second Chance Drawing: (if required)
    In the event of undistributed instant win prize monies, a second chance drawing will be conducted from all eligible Grand Prize Sweepstakes entries received. Winners of the Second Chance Drawing will receive a check in the amount of $25.00. Number of winners and odds of winning Second Chance Drawing dependent upon sum of undistributed instant win prize monies.

    All winners will be notified by mail. The Grand Prize Winners will be required to claim their prize by completing and signing an affidavit of eligibility, a liability release form and, except where prohibited by law, a publicity release, which must be returned via mail within ten (10) business days of notification postmark. In the event of non compliance with this time period, an alternate winner will be selected with no further compensation. If notification of prize award is returned to Sponsor as undeliverable, the prize will be awarded to an alternate winner with no further compensation.

    Winners may waive the right to receive a prize. The return of any prize or prize notification as undeliverable will result in disqualification, the forfeiture of all interest in the prize, and selection of a substitute winner from among all remaining eligible entries. Unless prohibited by law, acceptance of a prize constitutes permission for the Sponsor and its agencies to use the Winner’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation the Internet.
  9. GENERAL CONDITIONS: By entering, participants agree to be bound by these Official Rules and by the decisions of Sponsor and Sweepstakes judges appointed by Sponsor, which shall be final and binding in all respects. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or web site or to be acting in violation of these Official Rules or in an un-sportsmanlike or disruptive manner. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes. In the event that any tampering, fraud, virus, bug, technical error or failure, unauthorized intervention, or other problem which corrupts or affects the administration, security, fairness, integrity of the online portion of the Promotion, or for any reason Sponsor deems it necessary, the Sponsor may at its sole discretion cancel, terminate, modify or suspend the online portion of the Promotion and award any remaining prizes at random among all eligible entries received up to the time of impairment. Should the online portion of the Promotion be cancelled or altered prior to the stated expiration date, notice will be posted at http://www.transitions.com.

    CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR INSTANT WIN PORTION OF THIS PROMOTIONAL CAMPIAGN IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
  10. DISCLAIMERS: By entering, participants acknowledge and agree that the Sponsor, Transitions Optical Inc., and their respective parents, subsidiaries, affiliates, franchisees, advertising and promotional agencies and the officers, directors, employees, agents and representatives of each of the foregoing companies (collectively, the “Promotion Entities”), will not be liable for losses or injuries of any kind resulting from acceptance/possession/use and/or misuse of prize(s), travel to and from any prize-related activity, participation in the Promotion, printing, mailing or distribution errors, or any malfunctions of the computer Internet system, computer dating mechanism, computer equipment, software, or any combination thereof, unauthorized human intervention in the Promotion, for errors in the administration of the Sweepstakes or the processing of entries, or for any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, or otherwise not in compliance with these Official Rules. Promotion Entities are not responsible or liable for any injury or damage to any participant’s or third person’s computer and/or its contents, related to or resulting from Promotion. Participants release and agree to hold harmless Promotion Entities from any and all liability from any of the claims described above.

    Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to its web sites. Sponsor is not responsible for any problems or technical malfunction of any telecommunications network or telecommunication lines, computer on-line systems, servers, computer equipment, telecommunications network equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or on any web site, or any combination thereof.

    IN NO EVENT WILL ANY PROMOTION ENTITY BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ENTRY IN AND PARTICIPATION IN THE PROMOTION OR THE DOWNLOADING AND/OR PRINTING OF MATERIAL ASSOCIATED WITH THE PROMOTION. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE AND IN THIS PROMOTION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
